Role of Forensic Interviews Goes before Colorado Supreme Court

The Colorado Supreme Court heard oral arguments this week in a case debating the role of forensic interviews in criminal cases with child victims or witnesses. Public defenders argued that the testimony of the forensic interviewer leads the jury to give too much weight and credibility to the child’s statement, while the State argued that the only purpose of the interview is to elicit the child’s experience in his or her words. This case follows a line of cases debating the Confrontation Clause’s role in evidentiary rulings. The Ohio issued a ruling on a similar issue earlier this year. That opinion can be found here.
